Neill Fitzmaurice
Neill received his B.A. (Hons.) in Philosophy from the University of Toronto in 2014 and his law degree from the University of Toronto Law School in 2019. Before and during law school he worked closely with Innocence Canada, a non-profit organization aimed at freeing the wrongly convicted.
Since being called to the bar in 2020, Neill has focussed primarily on complex cases, including murder and criminal negligence causing death. He enjoys trial and appellate work and is passionate about protecting the Charter rights of his clients. He has made unlawful searches and the right to counsel a focus of his education and practice.
Recent cases:
In R. v. Z, 2021, Neill and John Fitzmaurice were successful in having 5 confessions to murder made during an undercover “Mr. Big” operation excluded at a preliminary inquiry after the judge found that the confessions were unreliable and could not be believed – believed to be the first case where a Mr. Big confession was excluded at a preliminary inquiry. This outcome was the result of extensive physical and forensic evidence led by the defence including blood spatter, ballistics, and pathology evidence. Following the exclusion of the confessions, the charge was stayed.
In R. v. M, 2021, numerous charges including two counts of impaired driving causing bodily harm were dismissed after the evidence of impairment was excluded due to serious violations to the accused’s Charter rights uncovered during cross-examination.
In R. v. R.V., 2021 SCC 10, Neill appeared as junior counsel to Philip Campbell in front of the Supreme Court of Canada in what is now the leading decision on the appropriate remedy for inconsistent jury verdicts.
